Terms of service

These terms govern access to Orbit, a social-media planning, publishing and analytics service operated by Orange X. By creating an account or using Orbit, you agree to these terms. Contact: chris@orangex.co.uk.

1. Using Orbit

You must be legally able to enter into this agreement and authorised to act for each business and social account you connect. You are responsible for accurate account information, protecting login credentials and activity performed through your account. Tell us promptly if you suspect unauthorised access.

2. Your content and permissions

You retain ownership of content you submit. You grant us the limited rights needed to host, process, adapt and transmit that content to provide Orbit. You confirm that you have the necessary rights, permissions and consents for content, media, personal data, logos and connected social accounts.

3. Review before publishing

Orbit can generate drafts, suggestions and visuals using AI. AI output may be incomplete or inaccurate. You are responsible for reviewing facts, claims, spelling, suitability, rights and regulatory compliance before approving publication. Scheduling or approving content instructs Orbit to attempt publication through the selected services.

4. Acceptable use

You must not use Orbit unlawfully; infringe rights; upload malicious code; attempt unauthorised access; evade limits; interfere with the service; publish deceptive, harmful or prohibited material; or use connected platforms contrary to their terms and policies.

5. Third-party services

Orbit depends on services including Meta, hosting, storage, email and AI providers. Their availability and rules are outside our control and may change. You must maintain valid permissions for connected accounts. We are not responsible for a third party rejecting, delaying, modifying or removing content, although we will take reasonable steps to report failures accurately.

6. Availability and changes

We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation. We may maintain, modify, suspend or discontinue features where reasonably necessary, including to address security, legal or platform changes.

7. Fees

If paid plans are introduced or selected, prices, billing periods, taxes, renewal and cancellation terms will be shown before purchase. These terms do not by themselves create a charge.

8. Suspension and termination

You may stop using Orbit and request deletion in accordance with our data-deletion instructions. We may restrict or terminate access for material breach, security risk, non-payment where applicable, unlawful use or where necessary to protect users or third-party services.

9. Disclaimers and liability

Orbit is provided with reasonable care and skill. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud or fraudulent misrepresentation, or death or personal injury caused by negligence. Subject to that, we are not liable for indirect or consequential loss, lost profits, lost opportunity, or losses caused by content approved by a user or failures of third-party platforms. Any further limitation applicable to a paid plan will be stated in the relevant order terms.

10. Privacy

Our privacy policy explains how we handle personal data. Businesses using Orbit remain responsible for ensuring that their own collection and publication of personal data is lawful.

11. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, except where mandatory consumer law provides otherwise.

12. Changes and contact

We may update these terms to reflect service or legal changes. Material changes will receive reasonable notice where appropriate. Questions can be sent to chris@orangex.co.uk.
